1. Agreement and operator
These Terms form an agreement between you and Grace Saquing, operating That Curly Mind in the Philippines (“That Curly Mind,” “we,” “us,” or “our”). They apply to thatcurlymind.space and its related analysis, account, report, and billing features (the “Service”).
By creating an account, purchasing access, or using the Service, you agree to these Terms and the incorporated Acceptable Use Policy and acknowledge the Privacy Policy and Refund and Cancellation Policy. If you do not agree, do not use the Service.
2. Eligibility and organizational authority
You must be at least 18 years old and legally capable of entering a contract. If you use the Service for a company, nonprofit, client, or other organization, you confirm that you are authorized to accept these Terms and submit the relevant content on its behalf.
3. What the Service provides
That Curly Mind helps users examine strategic, business, program, and related plans through structured strategy, innovation, and futures-thinking methods. Users submit plan content, select a method, and receive an AI-assisted analysis that may be saved and exported.
The Service is a decision-support tool. Its outputs may be incomplete, inaccurate, or unsuitable for your circumstances. They are not legal, financial, accounting, medical, regulatory, investment, or other professional advice. You are responsible for reviewing outputs, checking important facts, and deciding whether and how to act on them.
4. Accounts and security
- Provide accurate account information and keep it current.
- Protect your password and do not share access outside your authorized use.
- Notify us promptly if you believe your account has been compromised.
- You are responsible for activity conducted through your account unless applicable law provides otherwise.
We may require email verification, apply reasonable security controls, or temporarily restrict access to protect users and the Service.
5. Your content
You retain ownership of the plan text, documents, instructions, and other materials you submit (“User Content”). You grant That Curly Mind a limited, non-exclusive license to host, copy, transmit, extract, transform, and process User Content only as necessary to operate, secure, support, and improve the requested Service.
You confirm that you own or have permission to submit User Content and that processing it through the Service will not violate another person’s rights, confidentiality duties, law, or contract. Do not submit personal, regulated, legally privileged, export-controlled, or highly confidential information unless you have independently determined that doing so is lawful and appropriate.
6. Analysis outputs
Subject to these Terms and any third-party rights, you may use reports generated for your account for your own lawful business or organizational purposes. Because artificial-intelligence systems can produce similar material for different users, we do not promise that an output is unique.
You must exercise human judgment. Do not rely on an output as the sole basis for a high-impact decision about a person, legal compliance, financing, safety, employment, eligibility, or access to essential services.
7. Purchases, subscriptions, and taxes
Paid access may include one-time analysis credits and recurring monthly subscriptions. The checkout page displays the current price, currency, applicable taxes, and billing interval before purchase. Lemon Squeezy acts as the merchant of record and processes payment information, receipts, taxes, refunds, and chargebacks under its checkout terms.
A monthly subscription renews automatically at the displayed interval until cancelled. You authorize the merchant of record to charge the payment method on file for each renewal. You can cancel future renewals through the billing portal. Cancellation does not ordinarily refund or prorate the current period. See the Refund and Cancellation Policy.
8. Service availability and changes
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation. Processing can be delayed or unavailable because of maintenance, security events, capacity, connectivity, or third-party services. We may modify features, methods, limits, or prices prospectively. Material changes will be communicated where reasonably practicable.
9. Suspension and termination
You may stop using the Service at any time and may request account deletion. We may suspend or terminate access when reasonably necessary to address nonpayment, security risk, unlawful activity, material breach of these Terms, or harm to users or the Service. Where appropriate, we will provide notice and a reasonable opportunity to correct the issue.
Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, and dispute terms—will continue to apply.
10. Our intellectual property
The Service, interface, branding, software, prompts, report structures, documentation, and proprietary workflows are owned by That Curly Mind or its licensors. These Terms do not transfer ownership to you. You may not copy, resell, reverse engineer, scrape, circumvent, or create a competing service from protected elements except where applicable law expressly permits it.
11. Third-party services
The Service depends on third-party infrastructure for hosting, authentication, storage, email, AI processing, and payment. Those providers may apply their own terms to direct interactions with them. We are not responsible for third-party services outside our reasonable control, but we remain responsible for our own obligations under applicable law.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by law, That Curly Mind will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or opportunities, arising from use of the Service. Our total aggregate liability relating to the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim.
These limits do not apply where prohibited by law or to liability that cannot lawfully be limited, including liability caused by fraud or willful misconduct where applicable.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Before filing a formal claim, contact us and allow 30 days for a good-faith attempt to resolve the matter. Subject to rights and forums that applicable consumer law makes available, disputes will be brought before the competent courts of the Philippines.
15. Changes and general terms
We may revise these Terms as the Service or law changes. The effective date appears above. If a change materially affects your rights, we will provide reasonable notice and may ask you to accept the revised version before continued use. If one provision is unenforceable, the remaining provisions stay in effect. A delay in enforcing a provision is not a waiver.
